Start With Jurisdiction

Deck Builders in Laveen first have to sort out a detail that trips up a lot of projects: Laveen is not its own city. Since the mid-1990s, Phoenix has annexed a large share of the area, and that part is the Laveen Village, one of Phoenix's urban villages. The rest remains unincorporated Maricopa County. Two neighbors with the same Laveen mailing address can fall under different building departments. Before we draw a deck or patio cover, we confirm which side of that line your parcel is on.

If you are inside Phoenix

Phoenix publishes a guideline for residential patio covers. It defines them as one-story structures no more than 12 feet tall, open on two or more sides and attached to the house. It asks for a plot plan, cross-section, roof framing plan and foundation plan, and it allows homeowners to prepare their own drawings if they are accurate, legible and complete. Its conventional framing tables assume a 10 psf dead load with no tile roofing, a 10 psf minimum live load and footings at least 12 inches below undisturbed ground. Permits stay valid for 180 days from issue or from the last inspection, and the job is not legally complete until a final inspection passes. Phoenix also adds separate approvals for hillside lots and floodplain properties, both of which can apply near South Mountain and the Salt River.

If you are in unincorporated county land

For parcels outside Phoenix, Maricopa County Planning and Development handles the permit. Its attached patio and carport standards (dated April 2014) say a building permit is required to build, alter or repair a patio cover or carport. They call for Douglas Fir #2 or better framing, posts protected against decay and termites, two #4 rebar in each footing and a roof slope of at least a quarter inch per foot. The county inspects footings before concrete is poured, then framing, roof sheathing and a final. Setbacks and maximum lot coverage depend on the zoning, which the county confirms by parcel, and we check that the 2014 standards are still current before drawing.

Rural roots, room to build

Farmers and dairymen settled the area in 1884, and its motto is "Where rural is a way of life." The Cheatham family ran one of the state's larger dairies south of Baseline Road until 2003, when most of that land was sold to developers. Arlington Estates started construction in 2000, and subdivisions have filled in quickly since, especially after the Loop 202 extension through Laveen opened on December 21, 2019. Community groups have long pushed for equestrian trails and open space, so lot sizes and setbacks vary more here than in most Phoenix neighborhoods. A newer subdivision lot may need a compact deck tucked against the house, while an older acreage property can take a large freestanding covered deck or a shade structure near a pasture fence.

Heat and wind on open ground

Laveen sits in the Sonoran Desert near where the Salt and Gila rivers meet, with South Mountain to the south. Summer highs often exceed 105°F, and winter days hover around 65°F. Open fields and wide lots give wind a long run, so we pay close attention to post anchoring and bracing on covers and pergolas, and we pick lighter deck colors that stay cooler underfoot.

Laveen Details That Affect Your Project

  • Split jurisdiction. After annexations beginning in the mid-1990s, a large part of Laveen lies within Phoenix city limits as the Laveen Village, while the remainder is unincorporated Maricopa County. Phoenix took over the Laveen Fire Department in June 2002.
  • Phoenix patio cover rules. Phoenix defines a residential patio cover as one story, no more than 12 feet tall, open on at least two sides and attached to the house. Footings must be at least 12 inches below undisturbed ground, and permits last 180 days between inspections.
  • County permits for unincorporated parcels. Maricopa County requires a building permit to construct, alter or repair a patio cover or carport, with footing inspections before concrete is poured and a roof slope of at least 1/4 inch per foot.
  • Village planning committee. The Laveen Village Planning Committee generally meets the second Monday of the month at 6:30 p.m. at the Laveen Education Center, 5001 West Dobbins Road, and the village has its own Southwest Growth Study and Character Plan.
  • Rapid growth on former farmland. Settled by farmers and dairymen in 1884, Laveen saw Arlington Estates begin construction in 2000, and the Loop 202 extension through the area at about 59th Avenue opened December 21, 2019.

Laveen Questions

How do I know if my Laveen home is in Phoenix or the county?

Your property tax records usually show whether the parcel is inside Phoenix. Give us your address and we will confirm it before drawing anything, since it decides which building department reviews the plans.

Can I draw my own patio cover plans for a Phoenix permit?

Phoenix allows homeowners to prepare drawings if they are accurate, legible and complete, and it publishes framing tables for standard covers. When we build the cover, we prepare the drawings ourselves.

Is a permit needed to repair an existing patio cover in unincorporated Laveen?

Maricopa County's standards say a building permit is required to construct, alter or repair a patio cover or carport. Small cosmetic fixes may be different, so ask the county about your specific repair.

I have an acre lot. Can you build a freestanding covered deck away from the house?

Yes. Detached structures are common on larger Laveen lots. Setbacks and lot coverage depend on your zoning, which we confirm with Phoenix or the county before finalizing the design.
